The public will take notice that the Board of Commissioners of the Town of Ocean Isle Beach has called a public hearing at 8:45am on August 9, 2022 in the Town Meeting Hall located at 111 Causeway Drive, for a text amendment request from the developer of The Point OIB subdivision regarding Article IV – Building Permits – Section 10-112(c):


(c) The building inspector shall not issue a building permit unless the property is graded and filled at least eight inches above the centerline of the adjacent street. Elevations greater than eight inches above the street shall occur only in order to match adjacent property. Beginning at the front property line, the property shall slope from the grade at the street right-of-way line to an elevation of eight inches above the street centerline at the building line. The builder and/or owner shall be responsible for grading the lot in such a manner as to absorb surface runoff or divert it to the street.


(1) If said property is in a planned subdivision or planned unit development (PUD) with private roads and has obtained a state stormwater permit, the subdivision or PUD shall be exempt from ordinance Section 10-112(c) requirement to be eight inches above the centerline of the road. Subdivisions or PUD's wishing to use this exemption shall provide a recorded copy of their restrictive covenants requiring maintenance and continued compliance with their state stormwater permit requirements.


All interested persons are invited to attend and provide public comment.  A copy of the map can be reviewed at Town Hall between the hours of 8:00 am and 4:30 pm Monday through Friday.  The Board of Commissioners may adopt the proposals, reject the proposals or make modifications to the proposals based upon the public input received during the hearing.
